In his role as a neutral, Chuck has ruled on, or helped the parties resolve, hundreds of cases, in virtually all substantive areas of civil law. In the recent past, construction disputes, a variety of employment lawsuits and breach of contract actions have comprised a substantial percentage of cases handled.

City of Milwaukie v. Northland Insurance, U.S. District Court. Represented client on claim that its insurance carrier wrongfully denied coverage.

Fred Shearer & Sons v. General Insurance Company of America, Multnomah County Circuit Court. Represented contractor challenging denial of insurance coverage for asbestos-related claims.

Hammond Building Enterprises v. Munson, Multnomah County Circuit Court. Defended and counter claimed on behalf of building owner in construction dispute.

Klein Consulting Engineers v. Chart Development Corporation; Lance Construction and Engineering v. Chart Development Corporation, Washington County Circuit Court. Defended subdivision developer against engineer's claim for unpaid fees, and prosecuted counterclaim for wrongful lien and negligence.

Care Medical Equipment v. Baldwin; Care Medical Equipment v. Miller, Multnomah County Circuit Court. Represented ex-employees in covenant not to compete cases.

Davis v. Chay LLC., Multnomah County Circuit Court. Defended building owner in suit by purchaser for injunctive relief and damages.

Driggs, et al. v. Ruhnke, Multnomah County Circuit Court. Represented law firm on multiple claims relating to defendant's appropriation of the firm's clients.

Copelands Enterprises, Inc. v. NW Investors Marion County Circuit Court. Eviction of shopping center subtenant for breach of contract.

Copelands Enterprises, Inc. v. Pioneer Place Limited Partnership, Portland Development Commission, Multnomah County Circuit Court. Represented commercial tenant in claim against landlord and property owner for breach of sublease and interference with economic relations.

Herrick v. House, et al, Multnomah County Circuit Court. Represented property buyer in misrepresentation and other claims against seller and brokers.

Lacayo v. Sosa, et al. Multnomah County Circuit Court. Foreclosure of trust deed on commercial loan.

Northwest Strategies, Inc. v. American Medical Response, U.S. District Court, Western Washington. Defended misappropriation and Lanham Act claims.

Sause Bros. Ocean Towing Co. Inc. v. Olympic Tug & Barge Inc., U.S. District Court, Oregon. Defended tugboat company against barge line's claim of unfair competition.

Shenyang Baskets, LTD v. Munson, Clackamas County Circuit Court. Defended and counter claimed on behalf of wholesaler sued by Chinese manufacturer.

Shearer v. Morrow County, et al., U.S. District Court, Oregon. Represented employer in defense of wrongful termination claim.

Virtual Automated Technologies,Inc. v. Thuesen and Gemstar Investments, Inc. Multnomah County Circuit Court.Defended against plaintiff's claims of breach of stock sale and confidentiality agreements.

Western Planning Associates v. Grand Gates, Inc., Clark County Superior Court. Foreclosure of architect's lein on shopping center project.

Western Radio Services v. Michael Espy, et al., U.S. District Court, Oregon. Defended cellular telephone service provider against competitor's claims of preferential treatment in the issuance of cell tower permits by the US Forest Service.

Columbia Crossings, LLC v. Harbor Investors,LLC and Salpare Bay,LLC, Multnomah County Circuit Court. Represented condominium/moorage developer in easement dispute with neighboring moorage.

Representation of property owners in condemnation proceedings initiated by State of Washington, State of Oregon, Multnomah County, Clackamas County, Washington County, City of Albany, City of Portland, City of Newberg, NW Natural Gas and Portland Development Commission.

City of Tigard; City of Bend; City of West Linn; City of Milwaukie; City of Gearhart; City of Shady Cove; City of Springfield; PacifiCorp; Riverdale School District; Oregon City School District. Representation of local governments and utility in condemnation and easement encroachment cases.

Oregon Dept. of Transportation v. Highway 97 Limited Partnership, Deschutes County Circuit Court. Represented property owner in defense of state's condemnation proceeding and in prosecution of counterclaim for loss of access/inverse condemnation.

Represented property owners prosecuting or defending claims of adverse possession, trespass and related land use claims.

Evans v. Costello, Linn County Circuit Court. Defended claim that clients' lease with cellular tower company violated restrictive covenants.

Torts/Civil Rights

Driggs, et al. v. Ruhnke, Multnomah County Circuit Court. Represented law firm on multiple claims relating to defendant's appropriation of the firm's clients.

Emmert International v. City of Milwaukie, U.S. District Court, Oregon. Defended City in civil rights action alleging multiple constitutional violations. Trial court's dismissal of plaintiff's claims on City's motion for summary judgment affirmed on appeal by Ninth Circuit Court of Appeals.

Columbia Hills Development v. Columbia County, Columbia County Circuit Court. Represented property owners who were denied the right to construct a subdivision despite county's initial approval.

Clark v. City of Seaside, U.S. District Court, Oregon. Represented business owner wrongfully denied city permit.

City of West Linn v. Magkamit. Marion County Circuit Court. Represented client in action to collect $1.4 million embezzled by its finance director. Also coordinated the selection and work of outside counsel who pursued professional negligence claim against client’s auditor.

DeRousse v. City of Portland, Multnomah County Circuit Court. Represented subdivision developer wrongfully denied building permit.

Doney v. Clatsop County, Clatsop County Circuit Court. Represented property owner on takings claim for wrongful denial of a permit to construct an apartment complex.

Kennedy v. Clatsop County, Clatsop County Circuit Court. Represented property owner in establishing approved access for subdivision development.

Esquire Motors v. Tri-Met; Acres Investment Company v. Tri-Met; Phillip Stewart Incorporated v. Tri-Met, Multnomah County Circuit Court. Represented property owners on inverse condemnation, nuisance, trespass, and loss of access claims resulting from light rail construction project.

Feinauer v. Cantar Corporation, et al, U.S. District Court, Oregon. Represented minor in products liability action.

Koch v. Ingram, Multnomah County Circuit Court. Represented plaintiff on false arrest, defamation claims.

Suntek Park Company v. Tri-Met Transportation District, Washington County Circuit Court. Represented property owner on inverse condemnation/condemnation blight claim arising from light rail construction.

Threadgill v. Seventh Day Adventist Church, Multnomah County Circuit Court and U.S. District Court, North Dakota. Represented plaintiff who was sexually abused while a student at defendant's boarding schools.

1985-2007. During this period the representation of plaintiffs in personal injury and wrongful death cases comprised a substantial portion of Chuck’s caseload.


Other

Ferguson v. Medford Urban Renewal Agency, et al., Jackson County Circuit Court. Represented property owner challenging the legality of urban renewal project.

Martin v. City of Tigard. Washington County Circuit Court. Successfully defended multiple lawsuits challenging various aspects of the Dartmouth Street Local Improvement District, the LID that funded the property acquisition for and the construction of the street that opened the Tigard Triangle to commercial development.

Appellate Cases: Representation of clients before the appellate courts of Oregon and Washington, and the Ninth Circuit Court of Appeals.
